Regulations on Home Occupations

Some types of businesses are allowed to be run out of the home in Summit County and are addressed in Summit County Land Use & Development Code.

Home Occupations are defined as commercial enterprises conducted by a person in his or her residence or on the same lot as his or her residence. Figure 3-2: The Land Use Matrix (pdf) and Figure 3-3: Land Uses By District (pdf) denote where this use is allowed.

Categories


Types of Home Occupations are separated into three main categories:
1. Accessory Use Home Occupations: Home occupations that comply with the criteria listed in sections 3810.05.A and 3810.05.B are classified as Accessory Use Home Occupations. Examples of accessory use home occupations may include, but are not limited to:
  • Computer software developer or consultant
  • Web designer
  • Telemarketer.
2. Low Impact Home Occupations: Home occupations that comply with the criteria listed in sections 3810.05.A and 3810.05.C are classified as Low Impact Home Occupations. Examples of low impact home occupations may include, but are not limited to:
  • Portrait photographer or artist
  • Architect
  • Electrician or plumber
  • Civil, electrical or mechanical engineer
  • Home childcare (limited to not more than nine children, including infants and the children of the residents of the premises). Notwithstanding the foregoing, these regulations neither expressly nor implicitly exempt any home childcare operation from any permitting process required by Summit County, the State of Colorado, or any other applicable jurisdiction, as the same applies specifically to child care operations.
3. Moderate Impact Home Occupations: Home occupations that comply with the criteria listed in sections 3810.05.A and 3810.05.D are classified as Moderate Impact Home Occupations. Examples of moderate impact home occupations may include, but are not limited to:
  • Furniture repair
  • Small equipment repair
  • Doctor or dentist
  • Any home childcare operation consisting of more than nine children at any time, including infants and the children of the residents of the premises, is considered a moderate impact home occupation and is subject to conditional use permit review. Notwithstanding the foregoing, these regulations neither expressly nor implicitly exempt any home childcare operation from any permitting process required by Summit County, the State of Colorado, or any other applicable jurisdiction, as the same applies specifically to child care operations.

Review


All home occupations must be reviewed by the Summit County Planning Department to determine which type of review will be required for approval of the home occupation.
